Not if you are paying taxes on your winnings. The government wants their cut and any winnings are income and therefore subject to taxes. Winnings is not free money.
However, it does not keep people from playing poker in their homes either. It's hard to control.
In most states it's illegal. NJ and NV it's legal as long as it's via a casino. It's best if you check your own state's laws.
